iPhone Upgrade Users Attempt to Sue Apple
Members of the iPhone Upgrade Program claim that they have been unfairly treated. They allegedly were shut out from trading in their iPhones as promised on their deal.
Members are now looking to sue Apple after the difficulties in ordering one of the new iPhone 7s. Many new customers snapped up the latest phone after the announcement and have already pre-ordered theirs. The phone comes out in three days and those that pre ordered this week will get their handset before anybody else.
What is the iPhone Upgrade Program?
This program was introduced last year giving users an opportunity to pay a monthly fee and trade in their iPhone 6S when the opportunity presents itself. That opportunity would have been now as they began to pre-order iPhone 7 but many of those that tried unfortunately feel they were abandoned as Apple prioritised new users. The deal on the program was supposed to allow users to swap once they have waited six months and they’d go from paying $40 a month to then agreeing a similarly priced contact for the new model.
The Small Print
Although members were told that they could upgrade after six months it was also stated that they must have made at least 12 payments before being entitled to swap their current handset. This obviously doesn’t bode well for many of the owners as they began the program in March 2016. So the release of the iPhone 7 is just six months later, the only people eligible will be ones that paid two payments a month.
The Lawsuit
The class action lawsuit claims that Apple gave higher priority to non-iPhone users. According to the lawsuit the technology giant were telling the program members to check back later. The suit seeks an injunction and damages for all those affected and they also make an order that will see Apple make a full inventory of phones available to iPhone upgrade members.
